The First District Wisconsin Court of Appeals has upheld a decision to dismiss a lawsuit against Marquette University that alleged a former School of Dentistry student was dismissed because of discrimination, not poor academic performance, according to a story in the Marquette Tribune.
Ali Amir, who was born in Iran, received two F’s and one D during the fall 2000 semester and was allowed to repeat his first year in 2001 while on academic probation, according to records. He did not receive any failing grades in the fall 2001 semester but received an F and a D during the spring semester, as well as a D in summer school. He was formally dismissed from the dental school in 2002.
He filed a lawsuit in 2004 alleging that a white dentistry student in comparable circumstances was treated differently and given more chances to stay in school (that student was ultimately dismissed as well). That lawsuit was dismissed in 2006, but Amir has appealed it three times since, the Tribune reported.
