Woman sues oral surgeon acquitted of sexual assault

A Pennsylvania oral surgeon acquitted last month of sexually assaulting 17 female patients has been sued by one of the women who testified against him in that trial, according to a story in the Pittsburgh Post-Gazette.

The civil suit claims that Robert Boyda Jr., D.D.S., fondled the 29-year-old woman while she was under sedation with a mixture of drugs, including propofol. It includes allegations of assault, battery, false imprisonment, and negligence.

Two other women have filed notices that they plan to sue Dr. Boyda, but have not yet followed through with a complaint, according to the Post-Gazette.

Dr. Boyda was charged in January 2008 with several counts of assault, including involuntary deviate sexual intercourse, deviant sexual intercourse, indecent assault, indecent exposure, and corruption of minors. He was acquitted when the judge in the case said he did not believe the patients had reliable memories, as some of the drugs they had been given during treatment can cause hallucinations, vivid dreams, and sexual fantasies, according to expert witnesses and medical textbooks.
