Sulzer Mixpac, a maker of static mixers, cartridges, and dispensing devices, is pursuing legal action against other manufacturers selling copies of its static mixers for two-component cartridges and syringes.
In 2011, two lawsuits filed against anticompetitive copies of the mixers at the Cologne District Court in Germany were delivered to the suppliers of the copies at the International Dental Show (IDS). In both cases, the court issued default judgments in favor of Sulzer Mixpac.
The company said it has since discovered more copycat products. As a result, 10 interlocutory injunctions due to unfair competition were obtained from the Cologne District Court and filed against further suppliers of copies this week during IDS 2013. The company also delivered an action for infringement of community design against a supplier of modified mixers.
The company recommends that dental practitioners be sure that any Sulzer Mixpac products they use are from legitimate sources.
