A former dental assistant has filed a lawsuit against her former employer, charging him of "aggressive, cruel, and brutal conduct," according to a story in the Santa Fe New Mexican.
Elisa Archuleta worked for Kirk MacGillivray, DDS, in Santa Fe from 2005 to July 2011, according to the complaint, which was filed August 15 in the First Judicial District Court for New Mexico.
According to the complaint, Dr. MacGillivray regularly made disparaging remarks to Archuleta and allegedly mocked her by speaking with a "Mexican accent."
Archuleta told Dr. MacGillivray that such conduct was "insulting, offensive, demeaning, unprofessional, and illegal," and she wrote a letter to Dr. MacGillivray demanding that he cease such behavior, the complaint stated.
He then fired her, according to Archuleta.
The lawsuit seeks unspecified damages, including punitive damages, for battery, assault, intentional infliction of emotional distress, false imprisonment, and retaliatory discharge.
